1. About this policy

DR Analytics Recruitment (ABN 83 663 222 026) ("we", "us" or "our") values your privacy and is committed to protecting your personal information. We are bound by the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs), and, where applicable, by the Privacy and Responsible Information Sharing Act 2024 (WA) when we act as a contracted service provider to a Western Australian public entity under a contract that requires it.

This policy explains how we collect, hold, use and disclose personal information when you engage with our data, analytics, AI and software recruitment services in Australia, including as a candidate, client, referee, event attendee or website visitor.

2. Anonymity and pseudonymity

Where it is lawful and practicable, you may deal with us anonymously or using a pseudonym, for example when making a general enquiry. In most cases, however, we cannot provide recruitment services to you without your identifying information.

3. The kinds of personal information we collect

The personal information we collect depends on your relationship with us. It may include:

  • Your name, contact details, location and right to work or visa status.

  • Your CV or resume, work history, qualifications, certifications, skills and salary expectations.

  • Referee details and the content of reference checks.

  • Information generated during the recruitment process, such as interview notes, assessment results and correspondence.

  • For clients and contacts, your name, role, employer and business contact details.

  • Technical information when you use our website, such as your IP address, device and browser type and the pages you visit.

Sensitive information

Some roles require us to collect sensitive information, such as criminal history check results, health or medical information relevant to a specific role, or information about professional memberships. We collect sensitive information only where it is reasonably necessary for a role and only with your consent, unless an exception under the Privacy Act applies.

4. How we collect personal information

We collect personal information in a number of ways, including:

  • Directly from you, when you apply for a role, register with us, contact us, attend an event or complete a survey.

  • From third parties, such as your nominated referees, our clients, job boards and professional networking sites, where it is unreasonable or impracticable to collect it only from you.

  • From publicly available sources relevant to recruitment.

  • Automatically through our website and cookies.

Where we collect your personal information from someone other than you, we take reasonable steps to make you aware of that collection.

5. Why we collect, hold, use and disclose personal information

We use and disclose personal information to:

  • Assess your suitability for roles and present you to prospective employers.

  • Provide recruitment, contracting and career services to you and our clients.

  • Manage placements, contracts and our ongoing relationship with you.

  • Communicate with you about opportunities, market insights and our events.

  • Improve our services, website and user experience.

  • Meet our legal, regulatory and contractual obligations.

We will only use or disclose your personal information for a purpose you would reasonably expect, a purpose you have consented to, or as otherwise permitted under the Privacy Act.

6. Who we disclose personal information to

We may disclose your personal information, on a confidential basis, to:

  • Our clients (prospective employers), so they can assess your application.

  • Your referees and background, qualification and right to work checking providers.

  • Our IT, cloud and software service providers who help us run our business.

  • Our professional advisers, where reasonably necessary.

  • Government agencies, law enforcement or other authorities where required or authorised by law, or where necessary to protect our rights or the safety of others.

We do not sell your personal information.

7. Overseas disclosure

Some of our service providers store or access personal information overseas, including in the United States. These providers include Microsoft, Notion, Loxo (our applicant tracking system), Anthropic and Otter.ai. We also use other providers, including VXT for telephony, call recording and transcription, and where any of our providers store or access your information overseas the same safeguards apply. Before disclosing personal information to an overseas recipient, we take reasonable steps to ensure the recipient handles it consistently with the Australian Privacy Principles.

8. Direct marketing

We may send you information about roles, market updates, our community initiatives and events. You can opt out of these communications at any time by using the unsubscribe function in the message or by contacting us using the details below. We do not use sensitive information for direct marketing without your consent.

9. Cookies and website analytics

Our website uses cookies and similar technologies to operate the site and understand how it is used. You can manage cookies through your browser settings, although some features of the site may not function properly if cookies are disabled.

10. Data quality and security

We take reasonable steps to ensure the personal information we hold is accurate, up to date and complete. We also take reasonable technical and organisational steps to protect personal information from misuse, interference and loss, and from unauthorised access, modification or disclosure. These steps include access controls, staff training and use of reputable service providers. No method of electronic storage or transmission is completely secure, and while we strive to protect your information we cannot guarantee absolute security.

11. Retention and destruction

We retain personal information only for as long as it is needed for the purposes described in this policy and to meet our legal, regulatory and record-keeping obligations. As a general standard, we retain candidate, client and engagement records for seven years from your last meaningful interaction with us. This reflects our record-keeping obligations under section 535 of the Fair Work Act 2009 (Cth) and our company financial record obligations under sections 286 to 289 of the Corporations Act 2001 (Cth), together with the limitation periods that apply to potential legal claims. Some records, such as tax records, are kept for the period required by the relevant law (for example five years under section 262A of the Income Tax Assessment Act 1936 (Cth)), and where different periods apply we retain the record for the longest applicable period.

We may keep some information for longer where the law requires it, or destroy or de-identify it earlier where it is no longer needed for any purpose or where you ask us to and we are not otherwise required to retain it. When personal information reaches the end of its retention period, we take reasonable steps to securely destroy it or permanently de-identify it.

12. Data breaches

We maintain a data breach response plan. If we experience a data breach that is likely to result in serious harm to any individual whose information we hold, we will assess the breach and, where required under the Notifiable Data Breaches scheme, notify the Office of the Australian Information Commissioner (OAIC) and affected individuals as soon as practicable.

13. Accessing and correcting your information

You have the right to access the personal information we hold about you and to ask us to correct it if it is inaccurate, out of date, incomplete, irrelevant or misleading. To make a request, contact us using the details below. We may need to verify your identity before acting on your request. We will respond within a reasonable period. If we refuse access or correction, we will tell you why in writing and how you can complain.

We do not adopt, use or disclose a government related identifier (such as a tax file number or driver licence number) as our own identifier, except as permitted under the Privacy Ac
